Will a Consumer Proposal Stop Wage Garnishment in BC?

Generally, yes. Once your Licensed Insolvency Trustee files your consumer proposal, a stay of proceedings generally stops wage garnishment by the unsecured creditors included in the proposal. I'm Doug Thode, a Licensed Insolvency Trustee in Kelowna, helping people across the entire province of British Columbia and the Yukon, from Surrey and Abbotsford to Nanaimo, Vernon and Chilliwack.
How it works
When your trustee files the proposal, your creditors are notified, and collection action on the debts included in the proposal generally has to stop. That includes garnishment of your wages. Instead of losing part of every paycheque, you make one payment to your trustee under the terms of the proposal.
The limits
Some debts, such as child support and spousal support, are not stopped by a consumer proposal. Secured creditors may also keep their rights over the property they hold as security. Your trustee will go through exactly which of your debts are covered.
